Hosting Data Deletion Policy

Who deletes hosted data and how to authorize ConlineWeb deletions.

Important notice: This document is issued under applicable Mexican law for digital services and consumer relationships. It does not replace personalized legal advice. Terms agreed in writing in quotes, purchase orders, or signed contracts prevail when more favorable to the client and not contrary to law.

Scope

This policy governs hosting accounts, web hosting, email, databases, control panels (cPanel, WHM, or equivalents), and related environments that ConlineWeb assigns or manages for the client, whether directly or through third-party infrastructure.

It complements the Terms & Conditions, Managed Hosting Policy, Acceptable Use Policy, and Privacy Policy.

Client ownership and responsibility

When the client purchases a hosting plan and ConlineWeb assigns an account, the client is the operational holder and responsible party for that account and all information hosted in it, including without limitation:

  • Website files, applications, and media.
  • Databases, local backups, and exports.
  • Email accounts, mailboxes, and distribution lists.
  • Credentials, FTP/SFTP users, SSH keys, and API tokens.
  • Third-party content, end-user personal data, and business records.

It is the client’s sole responsibility to delete, export, anonymize, or retain information they no longer wish to keep on the server. ConlineWeb does not assume by default an obligation to erase client content upon delivery, administration, or account termination, except as expressly provided here or in a signed authorization document.

What ConlineWeb does not do without authorization

Except for a court order, competent authority request, serious security risk, or compliance with the Acceptable Use Policy, ConlineWeb does not routinely delete, modify, or download client content without express instruction.

The fact that ConlineWeb created, migrated, or managed the account does not transfer to the Provider indefinite custody or an obligation to purge the client’s information.

Deletion by the client

The ordinary process is that the client deletes information from the hosting panel, FTP, database, email, or tools provided to them.

On managed hosting plans, when the client has no panel access, they may request export or deletion from ConlineWeb under the signed-authorization section below or via a client-portal ticket.

The client must:

  • Keep their own backups before deleting.
  • Verify they are not deleting third-party data without a legal basis.
  • Close or transfer linked domains, DNS, and external services.

ConlineWeb is not liable for information loss from deletions by the client, their staff, or external providers they authorize.

Deletion by ConlineWeb (signed authorization)

If the client needs ConlineWeb to delete hosted information, they must:

  1. Request it in writing to info@conlineweb.com with subject “HOSTING DELETION AUTHORIZATION”.
  2. Sign an authorization document (physical or electronically valid) that:
    • Identifies the account, domain(s), and environment.
    • Lists specifically what information will be deleted (folders, databases, mailboxes, users, etc.).
    • States they have authority to order the deletion.
    • Accepts the action is irreversible and releases ConlineWeb from liability for loss of that data.
  3. Confirm the requester’s identity (contract holder or accredited attorney-in-fact).

Without a signed document detailing what will be deleted, ConlineWeb may refuse the request. Authorization does not create an obligation to restore or reconstruct deleted information.

Cancellation, late payment, and retention

After service cancellation, suspension for late payment, or contract termination:

  • The client has 15 calendar days (from the termination or final suspension notice) to export and delete their information, unless otherwise agreed in writing.
  • After that period, ConlineWeb may proceed with technical deletion of the account, files, databases, and associated email, without further notice or later copy delivery.
  • During late payment, the account may remain suspended; that does not guarantee indefinite data availability.

Personal data ConlineWeb processes as controller (billing, sales contact, tickets) is governed by the Privacy Policy and is distinct from content hosted in the client’s account.

Limitation of liability

To the maximum extent permitted by applicable Mexican law, ConlineWeb is not liable for:

  • Content the client failed to delete within the deadlines.
  • Loss from deletion authorized in writing.
  • Third-party infrastructure failures, attacks, force majeure, or the client’s own actions.
  • Privacy or ARCO obligations of the client’s end users, for whom the client acts as controller.
